If your visa has been denied since you last arrived in Australia or your visa has been denied and you are an illegal immigrant (ie no visa) or you have a temporary visa, this is referred to as “Section 48 bar”. Most other visa applications while in Australia are prohibited if “banned under section 48” (with a few very limited exceptions). This usually means you have to leave Australia. Being illegal in Australia or overstaying your visa can negatively affect your future visa application and citizenship status. From 13 November 2021, an S48 Bar waiver will be offered to qualified applicants for subclasses sc190, sc491 and sc494. This means that Section 48 applicants will be able to apply for sc190, sc491 and sc494 visas on land from the above date.
